By booking, accessing, or occupying any property managed by Cash Homes Solution, LLC DBA EverRest Homes (“Company,” “we,” “us,” or “our”), the individual completing the reservation and all occupants (“Guest,” “you,” or “your”) agree to be legally bound by these Terms & Conditions.
These Terms constitute a legally binding short-term or mid-term rental agreement.
The individual completing the booking represents that they have authority to bind all occupants and invitees to this Agreement.
The primary booking guest must be at least 21 years of age.
The primary guest must occupy the property for the entire duration of the stay.
Government-issued identification may be required.
Third-party bookings are strictly prohibited unless approved in writing.
Reservations obtained under false pretenses may be cancelled without refund.
A deposit or full payment is due at the time of booking.
Remaining balances are automatically charged on the scheduled due date.
Failure to complete payment may result in cancellation without notice.
Guest authorizes Company to charge the payment method on file for all amounts due under this Agreement.
Fraudulent disputes or chargebacks constitute breach of contract.
Company reserves the right to:
Collect a refundable security deposit; or
Place a temporary authorization hold on Guest’s payment method.
Guest is financially responsible for:
Property damage
Excessive cleaning
Missing or stolen items
Unauthorized events
Smoking violations
Pet violations
Unauthorized late checkout
HOA fines
Municipal citations
Neighbor disturbance fines
Company may charge the payment method on file for documented damages or violations.
Failure to maintain sufficient funds does not relieve Guest of liability.
100% refund if cancelled 45+ days before check-in
50% refund if cancelled 21–44 days before check-in
No refund within 21 days of check-in
No refunds for no-shows or early departures
100% refund if cancelled 60+ days prior
50% refund if cancelled 30–59 days prior
No refund within 30 days
Reservations overlapping high-demand events may be subject to stricter terms at Company’s discretion.
Guest is strongly encouraged to purchase travel insurance.
Refunds will NOT be issued for:
Illness
Airline cancellations
Personal emergencies
Weather not causing government evacuation
Event cancellations
Pandemic-related travel concerns
Financial hardship
Company shall not be liable for cancellations or interruptions caused by:
Natural disasters
Utility outages
Government orders
Acts of God
Safety hazards beyond Company control
Refunds may be provided only if the property becomes legally uninhabitable or government orders prohibit rental operations.
Guest acknowledges and agrees to the cancellation terms at booking.
Chargebacks inconsistent with this Agreement will be disputed and may result in recovery action, including legal fees and collection costs.
Guest agrees:
No parties, events, or commercial use unless approved in writing.
No smoking inside the property.
No illegal activity.
No subleasing.
Occupancy limits will not be exceeded at any time.
No additional visitors beyond disclosed guests without approval.
Violation may result in immediate termination without refund.
Parties, large gatherings, ticketed events, DJ equipment, promoters, filming, or advertised events are strictly prohibited without written approval.
If an unauthorized event occurs:
Immediate termination without refund
Minimum $1,000 event penalty (or documented actual damages, whichever is greater)
Responsibility for all related damages
Responsibility for HOA or city fines
Law enforcement may be contacted
Check-in: 3:00 PMCheck-out: 10:00 AM
Unauthorized late checkout will result in:
$25 per 15 minutes past checkout time
Additional cleaning fees
Any relocation costs incurred for incoming guests
Holdover exceeding 2 hours may be treated as trespassing.
If the property contains a pool, spa, or hot tub:
No lifeguard is on duty.
Use is at Guest’s sole risk.
Children must be supervised at all times.
No diving unless depth clearly permits.
No glass in pool area.
No intoxicated use.
Guest assumes all risks and releases Company and property owners from liability related to pool/spa use.
Guest agrees to indemnify Company for any claims arising from pool/spa use by Guest or invitees.
Pets require prior written approval.
Undisclosed pets: $500 penalty per animal.
Pets must not be left unattended unless crated.
Guest is responsible for pet-related damage, odor remediation, flea treatment, or additional cleaning.
Service animals must comply with applicable law; however, Guest remains liable for damages.
If the property is within an HOA, Guest agrees to comply with all HOA rules.
Guest is responsible for:
Any fines assessed due to Guest conduct
Administrative fees associated with violation processing
Charges may be applied to payment method on file.
Properties may contain:
Exterior security cameras
Noise monitoring devices that measure decibel levels only (no audio recording)
No cameras are located inside living areas or bedrooms.
Tampering with monitoring equipment is grounds for termination without refund.
Guest must report issues within 24 hours of check-in.
No refunds for minor inconveniences.
Company reserves the right to enter for maintenance, inspection, or emergency.
Guest acknowledges inherent risks associated with property use, including:
Slips and falls
Use of stairs, grills, fireplaces, appliances
Injury occurring on premises
Guest voluntarily assumes all such risks.
To the maximum extent permitted by law:
Guest releases and holds harmless Cash Homes Solution, LLC DBA EverRest Homes, property owners, employees, contractors, and affiliates from all claims arising from Guest’s occupancy.
Company shall not be liable for indirect, incidental, punitive, or consequential damages.
Total liability shall not exceed the total amount paid for the reservation.
Guest agrees to defend, indemnify, and hold harmless Company from:
Third-party claims
Injuries caused by Guest or invitees
Damage resulting from misuse
Legal violations during occupancy
All disputes shall be resolved through binding arbitration in Clark County, Nevada.
Guest:
Waives right to jury trial
Waives participation in class actions
Governing law: State of Nevada.
The prevailing party in any dispute is entitled to reasonable attorney’s fees and costs.
If any provision is unenforceable, remaining provisions remain valid.
This Agreement constitutes the entire understanding between Guest and Company and supersedes all prior communications.
